I. General provisions.

1. These regulations define the types, method of payment and principles of functioning of paid plans as part of the service of access to the "I must visit" service, provided by PERFECTCLUE Sp. z o.o., with its registered office in Rzeszów, ul. Zimowit 42, 35-605 Rzeszów, Poland, entered into the Register of Entrepreneurs maintained by the District Court in Rzeszów, XII Commercial Division of the National Court Register, under the number: 0000986621, NIP: PL8133882813, REGON: 522791227 via the Service located at: https://imustvisit.com.
2. These Regulations are effective from the date of their publication on the Service, i.e. from 28.01.2025.
3. The Service Provider reserves the right to make changes to these Regulations. The Service Provider will inform about changes to the Regulations immediately by making appropriate announcements via the https://imustvisit.com service at least one week before the changes are to become effective.
4. Communication between the Service Provider and the Service User, including the submission of any declarations of intent by the Service User, takes place in electronic form via the e-mail address: [email protected].

II. Types of paid plans.

1. Paid plans are available as part of the service of access to the "I must visit" service, which offers services in the scope of the possibility of adding and viewing short films showing attractive tourist places.
2. Paid plans are available only to Registered Service Users, i.e. Service Users who have an account in the "I must visit" service.
3. The Service User can choose one of three paid plans: Bronze, Silver or Gold. Each of these plans includes additional features compared to the default Free option:
   • Bronze Plan - the cost of the plan is $19.00 per month. It includes all the functionalities provided for in the default option and the following additional functionalities: verified account, cover photo and photo gallery.
   • Silver Plan - the cost of the plan is $99.00 per month. It includes all the functionalities provided for in the default option and in the Bronze plan, as well as the following functionalities: dedicated header, "Recommended" badge, and dedicated account manager.
   • Gold Plan - the cost of the plan is $299.00 per month. The plan includes all the functionalities provided for in the default option and in the Bronze and Silver plans, as well as the following functionalities: higher position in the search engine, presentation on the main page, and a post on social media.
4. In the remaining scope of the service, the "I must visit" service regulations will apply accordingly.

III. Payment method.

1. The payment process begins after clicking the "Choose" button in relation to one of the paid plans. Clicking the "Choose" button is equivalent to the conclusion by the Registered Service User of a service agreement in the form of access to the "I must visit" service together with the functionalities provided for in the selected plan (hereinafter referred to as the "Agreement for access to the paid plan").
2. The Service User is then redirected to the Stripe platform that supports payments. The Service User provides their credit card details on the Stripe platform.
3. The billing period lasts 1 month.
4. A specified amount is automatically debited from the user's account every month, depending on the type of plan selected.
5. The Service User may cancel the subscription via the "I must visit" service at any time. The subscription remains valid until the end of the billing period in which the cancellation was made.

IV. Termination of the paid plan access agreement.

1. The Service User may terminate the paid plan access agreement at any time by canceling the subscription.
2. The paid plan access agreement is terminated on the last day of the billing period in which the subscription was canceled.
3. The paid plan access agreement may be terminated by the Service Provider only for important reasons.
4. Termination of the paid plan access agreement does not affect the validity of the "I must visit" portal access service provision agreement in its default version.

V. Complaint.

1. In the event of the Service Provider's failure to provide the services or the services not being provided in accordance with the provisions of these Regulations, the Service User has the right to file a complaint. The complaint should include a detailed description of the situation of the Service Provider's failure to provide or the service not being provided in accordance with these Regulations of access to any of the paid plans.
2. Complaints should be submitted exclusively to the e-mail address: [email protected].
3. The Service Provider is obliged to respond to the complaint within 14 days of its receipt.
4. Responses to the complaint will be provided to the e-mail address of the Registered Service User provided during registration.

VI. Applicable law, final provisions and referral.

1. In matters not regulated by these Regulations, the provisions of generally applicable Polish law shall apply, in particular the provisions of the Act of 18 July 2002 on the provision of services by electronic means and the Civil Code.
2. Any disputes that may arise in connection with the provision of the service described in these Regulations shall be resolved on the basis of generally applicable provisions of Polish law. The provision contained in the preceding sentence does not exclude the rights that the Service User is entitled to under the mandatory provisions in force in the territory where the Service User has their habitual residence.
3. The Regulations are permanently available free of charge to Service User at the following address: https://imustvisit.com/en/business/terms.
4. In all matters not regulated by these Regulations, in particular in matters relating to the prohibition of providing illegal content and the protection of personal data on the I must visit portal, the I must visit website Regulations shall apply.
5. The English version of these regulations is only a translation of its original Polish version. If there are any differences between the Polish and English version, the Polish version should be applicable.
